During the launching of MAPS in March 2014, Zambry has publicly announced that MAPS will open its doors to the public by the end of 2015. This has turned out to be a lie as the Special Internal Audit shows that in the turnkey contact between ATP and SDGM the date to open up the park is 31 March 2016.
The Special Internal Audit on MAPS in 4.1.2 exposed that the obligation to open up MAPS as per license agreement between ATP and DreamWorks Animation LLC (DreamWorks) was not consistent with the time of completion as stated in the turnkey contract between ATP and SDGM.
On the 1 Jan 2013, ATP signed a license agreement with DreamWorks for the rights to use several animation characters in the Theme Park. It was clearly specified in the License Agreement that if the Licensee(ATP) failed to open the park to the general public by 31 Dec 2015, DreamWorks has the right to terminate the license agreement.
On 31 March 2014, ATP signed the turnkey contact with SDGM where the agreed date to open up the park is 31 March 2016.
Why did Zambry allow ATP to signed an agreement with SDGM to open up MAPS by 31 March 2016, when there is a prior agreement with DreamWorks to open up the park by 31 Dec 2015 which was the date he publicly announced.
Did Zambry purposely lie to the public when he announced that the park opening date will be the end of 2015 when ATP has signed an agreement with SDGM with the opening date of 31 March 2016?
The opening date of the park has been postponed twice, from the December 2015 to July 2016, and later to June 2017 where the park is open to public minus the Dream Zone.
I will explain in my statement tomorrow the total amount of penalty in creative services fee and extension fee ATP has to pay to DreamWorks for delaying MAPS opening date for 18 months.
